1. Purpose and scope
These Terms of Use (the “Terms”) set out how MODAI LAB (the “Publisher”) makes the services of the ModAi Lab platform, at modai-lab.com (the “Platform”), available.
Any use of the Platform implies unreserved acceptance of these Terms. The Publisher may amend them at any time. Amendments take effect on publication on the Platform. Where a change is substantial, the user will be notified by email at least 30 days before it takes effect.
These Terms apply to any individual or legal entity (the “User”) accessing the Platform, whether free of charge (trial) or paid.

3. Access to the Platform and account creation
3.1 Conditions of access
Access to the Platform is reserved for individuals of full age (at least 18) and for duly authorised legal entities. The User declares that they have the legal capacity to enter into these Terms.
3.2 Creating an account
An account is required to use the Platform. On registration, the User undertakes to provide accurate, complete information and to keep it up to date. An account is created with a valid email address and a password, or through a third-party identity provider (Google). The User is responsible for keeping their credentials confidential.
3.3 Free credits and access without a subscription
ModAi Lab runs on a credit system that gives access to missions and exercises without a subscription. Every new User receives free credits on first sign-in. When an active account runs low, new credits are granted automatically and free of charge within 24 hours, with no action required, up to a number of free top-ups set by the Publisher as a trial. Once that limit is reached, automatic top-up stops and continued access requires buying credits or taking out a subscription.
The User may also buy additional credits to reach more content. The purchase terms, the non-refundable nature of purchased credits and the associated guarantees are set out in article 4 of the Terms of Sale.
3.4 One account per user
Each User may hold only one account. Creating multiple accounts is strictly prohibited. The Publisher may delete any duplicate account without notice.
4. Description of the services
ModAi Lab is a platform for learning SQL (Structured Query Language), aimed at professionals who want to build or strengthen their relational database skills. The services include:
- •An initial assessment quiz that analyses the User's level using artificial intelligence
- •Personalised learning paths generated by AI from the User's profile and goals
- •Interactive SQL exercises (missions) on real or simulated business cases
- •A real-time SQL execution engine on dedicated PostgreSQL databases
- •An AI coach (powered by Google Gemini) to guide and correct SQL queries
- •A dashboard tracking progress and skills by SQL concept
The Publisher may amend, temporarily suspend or permanently withdraw all or part of the services, in particular for maintenance, technical or strategic reasons, giving reasonable notice except in an emergency.
5. User obligations
5.1 Personal use
The User undertakes to use the Platform solely for personal, non-commercial purposes, unless the Publisher has given express prior written consent. Sharing an account with third parties is prohibited.
5.2 Prohibited conduct
The User undertakes not to:
- •Attempt to circumvent the Platform's authentication, rate-limiting or security mechanisms
- •Access or attempt to access other users' data
- •Carry out reverse engineering, scraping or automated data extraction
- •Submit SQL queries or any other content that is malicious, destructive or harmful to third parties
- •Use the Platform for unlawful or improper purposes
- •Assign, rent or transfer their account to a third party
- •Reproduce or redistribute the learning content without written permission
- •Disrupt the proper working of the Platform or its servers
5.3 Responsibility for submitted content
The User is solely responsible for the SQL queries and any other content they submit on the Platform. They warrant that such content is lawful and does not infringe third-party rights. The Publisher may remove any manifestly unlawful content and suspend or terminate the account concerned.
5.4 Sanctions for abusive use
The Publisher may apply graduated measures against any User whose conduct is abusive, in particular automated use of the Platform, circumvention of rate limits, mass submission of queries for non-educational purposes, or any other conduct that diverts the service from its purpose.
Those measures may include, without limitation:
- •A temporary or permanent limit on the number of missions and exercises available per day
- •A temporary suspension of the account
- •A permanent ban from the Platform
Where an account is suspended or banned for abusive use, no refund will be made for the current subscription period, in accordance with article 12.2 of these Terms.
6. Intellectual property
6.1 The Publisher's property
Everything making up the Platform — in particular the text, exercises, missions, learning concepts, demonstration databases, interfaces, logos, trade marks, source code, algorithms, AI prompts and software architecture — is protected by intellectual property rights and belongs exclusively to MODAI LAB or is licensed to the Publisher.
Any reproduction, representation, modification, publication, transmission or distortion, in whole or in part, of those elements, by any means and on any medium, is strictly prohibited without MODAI LAB's prior written consent, on pain of legal action.
6.2 Licence granted to the User
The Publisher grants the User a personal, non-exclusive, non-transferable and revocable licence to use the Platform strictly within these Terms and for the duration of the active subscription. This licence confers no ownership over any part of the Platform.
7. Artificial intelligence and generated content
ModAi Lab uses artificial intelligence models (Google Gemini) to assess levels, generate exercises, provide coaching and personalise learning paths. The User is informed that:
- •AI-generated content may contain errors or inaccuracies; it is provided for learning purposes and does not constitute certified teaching
- •The AI coach's answers do not replace the advice of a qualified human trainer
- •Data submitted by the User is not used by Google to train its Gemini models (in accordance with the Google Gemini Enterprise API terms); it is processed solely to produce the session's answers
- •The Publisher does not warrant that the AI's suggestions are optimal for every production SQL environment
8. Availability and service interruptions
The Publisher endeavours to keep the Platform available 24/7. Access may nonetheless be suspended temporarily for planned maintenance (the User will be notified as soon as practicable), technical updates, outages at infrastructure providers (Google Cloud, Firebase), or events of force majeure.
The Publisher cannot be held liable for interruptions not attributable to its fault, nor for data loss arising from such interruptions where they result from an external, irresistible and unforeseeable event.
9. Limitation of liability
To the extent permitted by French law, the Publisher cannot be held liable for direct or indirect damage arising from the use of, or inability to use, the Platform, in particular: loss of data, loss of revenue, commercial harm, damage to reputation or non-material harm.
The learning content on ModAi Lab is provided for information and training. MODAI LAB does not guarantee employment, certification or any particular professional outcome on completion. Performance in the exercises does not predetermine the User's actual skills in a professional setting.
The Publisher's liability may not exceed, on all counts combined, the amounts actually paid by the User over the previous 12 months.
10. Personal data protection (GDPR)
Processing of the User's personal data is governed by the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and French law no. 78-17 of 6 January 1978 on data processing, data files and individual liberties.
10.1 Data collected and purposes
- •Identification data (email, name) — purpose: account management and customer relations
- •Learning data (quiz answers, SQL queries, scores, progress) — purpose: AI personalisation of the learning path and progress tracking
- •Technical data (connection logs, IP address) — purpose: security and abuse detection
- •Billing data — handled directly by Stripe; the Publisher does not store bank details
10.2 Legal basis
Processing rests on: performance of the contract (delivery of the service), legal obligation (retention of billing data), and the User's consent for optional marketing communications.
10.3 Your rights
Under the GDPR you have the right of access, rectification, erasure (the “right to be forgotten”), restriction of processing, portability and objection. To exercise them: contact@modai-lab.com. If a complaint remains unresolved, you may refer the matter to the CNIL (www.cnil.fr).
10.4 Retention period
Data is kept for the duration of the active subscription and for up to 3 years after cancellation or account deletion, unless a legal obligation requires longer (billing data is kept for 10 years under the French Commercial Code).
11. Cookies
The Platform uses cookies and similar technologies. Under the ePrivacy Directive (2002/58/EC) and CNIL guidance, non-essential cookies require your prior consent.

- •Analytics cookies (legal basis: consent): analysis of Platform use and service improvement

You can manage your preferences at any time through the "Cookies" link in the site footer or, once signed in, from the "Feedback & help" section of the Platform menu.
12. Suspension and termination of the account
12.1 Termination by the User
The User may close their account at any time from their personal area or by contacting customer service at contact@modai-lab.com. Closing the account deletes it and its associated data within 30 days, subject to legal retention obligations.
12.2 Termination by the Publisher
The Publisher may suspend or terminate an account, without notice or compensation, in the event of: breach of these Terms, fraudulent conduct, abusive use of the Platform (article 5.4), use that infringes third-party rights or the integrity of the Platform, or non-payment of the subscription. Where termination is for serious cause, no refund will be made.
13. Changes to these Terms
The Publisher may amend these Terms at any time. Any substantial change will be notified to the User by email with at least 30 days' notice. If the User does not accept the new Terms, they have that period to close their account free of charge. Continuing to use the Platform after the new Terms take effect constitutes acceptance.
14. Governing law and dispute resolution
These Terms are governed by French law. In the event of a dispute over their interpretation or performance, the User and the Publisher undertake to seek an amicable solution before any legal action.
Consumer mediation (art. L612-1 of the French Consumer Code): under order no. 2015-1033 of 20 August 2015, where a dispute is not settled amicably, a consumer User may use a consumer mediator free of charge. The Publisher will provide the competent mediator's details on request to contact@modai-lab.com.
Online dispute resolution: the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr
Failing an amicable settlement, the courts having jurisdiction over MODAI LAB's registered office shall have sole jurisdiction, save for mandatory consumer provisions to the contrary.
